(We commented on the case of nurse Sandie Peggie v NHS Fife Board and Dr Beth Upton on 11 December 2025. We undestand that case to be under appeal as we write and has it no formal connection with this new case).
Sandie Peggie, a nurse at Victoria Hospital, Kirkcaldy, has been involved in another case arising out of her employment, this time with her Trade Union, the Royal College of Nursing. The case has now been dismissed by Employment Judge Melanie Sangster. We cannot work out why it was dismissed because of the strange way the decision has been presented to the public by Employment Judge Sangster.
The decision extends to 37 pages. It names and identifies 15 individuals in the preamble but, thereafter and throughout the decision, refers to those individuals only by their initials. The result is, quite frankly, an unreadable mess. The decision is impossible to follow in any logical order. We are surprised, to say the least, that the Employment Tribunals Service has allowed the decision to be presented for public consumption in this sorry state.
Our view is that Ms Peggie would have had better prospects in raising this current action in the Civil Courts as a an ordinary, everyday case of Breach of Contract against her union. At least then the Judgement would have been clearer, much clearer, for the public to follow.
It's a bourach the way it stands.
