It would be very churlish of us not to congratulate our old friend, Lord Carloway, on his appointment as Lord Justice General, the new 'high heid yin' of Scottish Law. Hitherto, he was Number 2 but, now, he's Number 1. While Colin has many good points, there are two things that cause some unease about his appointment.
The first is that, alone in the judiciary, he was greatly for doing away with corroboration in Scottish criminal law and, indeed, produced a formal report to that effect. That issue of corroboration has been kicked into the long grass for the time being but for how long?
The second is that we are far from certain about his case relationship with the top tier of justice in the UK, the Supreme Court. From what we have seen so far, things have been rather awkward.
Time, as they say, will tell.
