MALICIOUS PROSECUTIONS

We never for a solitary second thought that this could ever happen in Scotland but the big legal story of the past  week  has been the malicious prosecution by the Crown of Paul Clark and David Whitehouse,  the Insolvency Practitioners involved in the liquidation of Rangers Football Club some nine years ago.  Yesterday,  in the Court of Session, where the pair are suing the Lord Advocate for many £millions,  the counsel acting for the Lord Advocate told the court that 'it is clear they should never have been prosecuted at all'.

The Lord Advocate of the day who authorised the prosecution was one Francis Mulholland CBE PC QC,  now the Court of Session judge Lord Mulholland.  Quite why  Lord Advocate Mulholland authorised a malicious prosecution and,  in the process,  pursuing both Mr Clark and Mr Whitehouse through the criminal courts,  is something that only he can tell and will keep the lawyers talking for many years to come.  It's a shocking disgrace.

At the moment we know nothing further so that we cannot comment other than to say that if it could happen to high-flying professionals like Mr Clark and Mr Whitehouse it could certainly happen to  any of us here in Crofting Lands.  Other than to say that this all happened under a Scottish Nationalist government, supposedly paragons of everything that is virtuous,  we'll keep schtum for the time being.
